Self-host License

The terms on which you install and run Wixzel Phone on your own servers after buying a self-host license.

1. Who this is between

This Self-host License (the License) is an agreement between you and Aqeel Shamsudheen, trading as Wixzel, a sole proprietorship in India (Wixzel, “we”, “us”). It applies when you buy a self-host license for Wixzel Phone, and you accept it by buying one. If you buy on behalf of a company, you confirm you may bind it, and “you” means the company.

Your account on phone.wixzel.com, which you buy and install with, stays under the Terms of Service. Where the two differ about the Software, this License applies.

2. What you are licensed

The Software is the self-hosted edition of Wixzel Phone: every release of it we make available to your account, the installer that sets it up, and its source code.

We grant you a non-exclusive, non-transferable, perpetual licence to install, run and modify the Software as this License allows. The licence is perpetual unless it ends under Termination. The Software is licensed, not sold.

3. What you may do

  • Install and run the Software on any number of servers that you, or contractors working for you, control.
  • Let your employees, and contractors working for you, use it for your business.
  • Change the source code for your own use.
  • Use it to run your own products and services, including ones your customers use, as long as nobody outside your business is given access to the Software itself: its console, its API or its MCP server.
  • Keep copies of the releases and the source code for backup.

4. What you may not do

  • Sell, resell, rent, lease, lend, sublicense or distribute the Software, its source code or a changed version of either, or give them to anyone outside your business.
  • Host the Software for another business or person, or offer access to it as a service, including under your own name or brand.
  • Use the Software or its source code to offer a product that competes with Wixzel Phone.
  • Remove or change the copyright and licence notices in the Software.
  • Share the installer, the release downloads or your account with anyone outside your business.

You may not transfer this License, except to someone who acquires your whole business, and then only with our written consent, which we will not refuse unreasonably.

5. Releases and updates

While this License is in force, every release of the self-hosted edition that we publish is available to your account, through the installer and the downloads on Self-host. There is no charge for them. You decide whether and when to install one.

We do not promise any particular feature, or how often releases come. If we stop publishing releases, we will say so on the site, and your right to run the releases you already have continues.

6. Running it is your responsibility

  • You run the servers. Their security, backups, availability and costs are yours, and so is keeping the Software up to date.
  • You hold the accounts with the voice providers and the carriers the Software uses, you pay them, and their terms apply to you.
  • You are responsible for the calls placed with the Software and for complying with the law, including telemarketing, call recording, consent, privacy and consumer-protection law. The Acceptable Use Policy applies to your use of the Software as it applies to the hosted service.
  • You decide what data the Software processes, and you are its controller. We have no access to your servers or the data on them.

7. The installer

If you choose to install over SSH, you authorise us to connect to the server you name, once, to check it and start the install. The password or key you enter is used for that connection only and is not stored.

While an install or an update runs, the server sends its progress to your account on phone.wixzel.com: the steps, the installer’s log and whether it succeeded. We keep that record with the install, as the Privacy Policy describes for account data. Once the install finishes, the server sends us nothing.

8. Price, payment and refunds

The price is the one shown at checkout, paid once. Dodo Payments takes the payment as merchant of record and adds any tax due where you are.

Refunds are handled under the Credits and Refunds policy. A refund, or a chargeback that reverses the payment, ends this License.

9. Ownership and third-party software

The Software, its source code and the Wixzel name and marks belong to us or our licensors. Changes you make are yours to use under this License. Feedback you give us may be used without obligation to you.

The Software includes open-source components, such as Asterisk, under their own licences. Those licences govern those components, and nothing in this License limits the rights they give you.

10. No warranty

The Software is provided “as is”, without warranty of any kind. To the fullest extent the law allows, we disclaim every warranty, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Software will be error-free, secure or work with your servers, carriers or providers. AI-generated speech and text can be wrong; you are responsible for how you use it. Support is by email at aqeel@wixzel.com on a best-effort basis.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to the Software or this License, however caused, even if we were told they were possible.

Our total liability for everything arising out of or relating to the Software or this License is limited to the amount you paid for the License.

Nothing in this License limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

12. Termination

  • This License ends if the payment for it is refunded or reversed.
  • We may end it by notice if you breach it and do not fix the breach within 30 days of that notice. A breach of What you may not do by selling, hosting or distributing the Software ends it immediately on notice.
  • When it ends, you must stop using the Software and delete every copy of it and its source code, and the installer and downloads stop working for your account.
  • What you may not do, Ownership, No warranty, Limitation of liability and Governing law survive the end of this License.

13. Governing law and changes

This License is governed by the laws of India, and disputes are resolved as the Terms of Service set out.

We may update this License for future purchases. A change does not reduce the rights of a license already bought, unless you agree to it.
